Terms of Use

These Terms of Use ("Terms") govern your access to and use of the SetPurple mobile application and website (collectively, the "Service"), operated by SetPurple ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18, you represent that you have your parent's or guardian's permission to use the Service. By using the Service, you represent that you meet these requirements.

2. Your Account

You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us immediately at support@setpurple.com if you believe your account has been compromised. We are not liable for any loss resulting from unauthorized use of your account.

You may delete your account at any time from the Settings screen in the app. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

3. What the Service Does

SetPurple connects to your AiM MyChron data logger over your local WiFi network, downloads your session files, processes them on your device, and generates plain-language performance insights. The Service is available on iOS and Android and uses AI-generated analysis to help you understand your data between sessions.

4. License to Use the Service

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms. You may not:

• Copy, modify, distribute, sell, or sublicense any part of the Service.
• Reverse engineer, decompile, or attempt to extract the source code of the app.
• Use the Service to build a competing product or service.
• Scrape, crawl, or systematically extract data from the Service.
• Use automated tools to access the Service without our written permission.
• Circumvent any access controls or security features.

5. Your Content

You own the session data, notes, and other content you submit to the Service ("Your Content"). By submitting Your Content, you grant us a limited license to store, process, and use it solely to provide the Service to you — including generating AI insights and, if you opt in to public sharing, contributing anonymized metrics to community benchmarks. We do not claim ownership of Your Content.

You are responsible for ensuring you have the right to submit any content you provide. Do not submit content that is unlawful, harmful, or that you do not have permission to share.

6. Sharing Features

If you choose to share a session or lap with another user, that user will see a browser-rendered view of that content. Raw telemetry data is never made available for download by other users. You control your sharing settings and can revoke access at any time. You are responsible for the content you choose to share.

If you opt in to public benchmarks, anonymized metrics from your sessions may be visible to other SetPurple users. You can opt out at any time in Settings.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Harass, harm, or impersonate any person.
• Upload malicious code or interfere with the Service's operation.
• Attempt to gain unauthorized access to any part of the Service or another user's account.
• Post or share content that is defamatory, obscene, or infringes on another's rights.

We reserve the right to suspend or terminate accounts that violate these rules.

8. Third-Party Services

The Service uses third-party providers including Anthropic (AI analysis), cloud infrastructure providers, and weather data services. Your use of the Service is also subject to Apple's and Google's applicable terms when you download and install the app. We are not responsible for the conduct of third-party services.

9. Fees and Payments

The Service is currently free to use. If we introduce paid features in the future, we will provide clear notice before any charges apply. Any paid features will be subject to additional terms presented at the time of purchase. Subscriptions purchased through the App Store or Google Play are subject to those platforms' billing and refund policies.

10. Intellectual Property

The SetPurple name, logo, app design, and all content we create are owned by us and protected by intellectual property law. These Terms do not grant you any rights to our trademarks, logos, or other brand elements. All rights not expressly granted here are reserved.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY INSIGHTS OR ANALYSIS WILL BE ACCURATE OR COMPLETE.

AI-generated insights are probabilistic in nature. They may contain errors. Always apply your own judgment when making setup or driving decisions.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SETPURPLE AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain liability exclusions. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

13. Indemnification

You agree to indemnify and hold harmless SetPurple and its officers, employees, and affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your violation of these Terms.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service, with reasonable notice where practicable. Sections 5, 10, 11, 12, 13, and 15 survive termination.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Kentucky, United States, without regard to conflict of law principles. Any dispute arising from these Terms or the Service will be resolved in the state or federal courts located in Kentucky, and you consent to personal jurisdiction there.

For users in the European Union or other jurisdictions with mandatory consumer protection laws, nothing in these Terms limits any rights you have under those laws.

16. Apple App Store — Additional Terms

If you downloaded the app from Apple's App Store, the following also applies: These Terms are between you and SetPurple only, not Apple. Apple has no obligation to provide maintenance or support for the app. In the event the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app. Apple is a third-party beneficiary of these Terms and may enforce them against you.

17. Google Play — Additional Terms

If you downloaded the app from Google Play, the following also applies: These Terms are between you and SetPurple only, not Google. Google has no obligation to provide maintenance, support, or warranty for the app. Google is not responsible for addressing any claims relating to the app or your use of it. In the event of any conflict between these Terms and the Google Play Developer Distribution Agreement, these Terms govern your relationship with SetPurple. Google Play's billing policies apply to any in-app purchases made through the Google Play platform.

18. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and notify you via in-app notice or email. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, stop using the Service and delete your account.
